TERMS OF SERVICE
Terms of Service
Website use, online ticket sales, and visits to Dark Hour Haunted House and the North American Cryptid Museum
Effective Date: [INSERT EFFECTIVE DATE]
These Terms of Service (“Terms”) apply when you use our websites, buy or manage tickets, communicate with us about a purchase, or visit Dark Hour Haunted House or the North American Cryptid Museum. “Dark Hour,” “we,” “us,” and “our” mean Dark Hour Designs LLC., doing business under those names. By using the website, buying a ticket, or entering the venue, you agree to these Terms and any event-specific rules shown during checkout or posted at the venue.
1. Eligibility and Responsibility for Your Group
You must be at least 18 years old, or have permission from a parent or legal guardian, to make a purchase. The person who buys tickets is responsible for providing accurate information and for making sure everyone in the ticketed party receives and follows these Terms, safety warnings, and venue rules.
Children and minors must be supervised as required by the event’s posted rules. Parents and guardians are responsible for deciding whether an attraction is appropriate for a child.
2. Ticket Purchases
Prices, fees, and taxes
Ticket prices, service fees, taxes, add-ons, and other charges are shown during checkout. Prices and availability may change before an order is completed. A ticket is not reserved until payment is accepted and a confirmation is issued.
Order acceptance and errors
We may refuse, cancel, or correct an order when there is a pricing or availability error, suspected fraud, duplicate transaction, payment problem, prohibited resale, system error, or violation of these Terms. If we cancel a paid order for one of these reasons and the ticket has not been used, we will provide the appropriate refund or correction.
Ticket delivery and account information
Tickets may be delivered by email, text, attendee account, QR code, or another method offered by the ticketing platform. You are responsible for providing accurate contact information and checking spam or junk folders. Contact us before the event if you cannot locate your ticket.
Lost, copied, or shared tickets
Treat each ticket and QR code like cash. The first valid scan may be accepted, and a copied, previously used, altered, or invalid ticket may be denied. We are not responsible for tickets shared without permission, but we may try to help verify an order when sufficient information is available.
3. Refunds, Exchanges, and Purchase Protection
Unless an event-specific policy says otherwise, ticket sales are final and nonrefundable. This includes missed events, late arrival, weather or travel problems, illness, fear, dislike of the attraction, transportation or parking issues, and removal for violating rules.
We may allow a ticket to be moved to another available date or time when requested before the original entry time. Changes are not guaranteed, may be limited by availability or event rules, and may require payment of a price difference or fee. A change is not complete until we confirm it.
Optional purchase protection, ticket insurance, or similar coverage is provided by a separate third party. Claims, eligibility decisions, documentation, deadlines, and payments are controlled by that provider’s terms. Buying protection does not change Dark Hour’s no-refund policy, and Dark Hour does not decide or pay third-party claims.
If Dark Hour cancels an event and does not offer a reasonable rescheduled date or replacement experience, the remedy will be the refund, credit, or other option stated in the cancellation notice. We are not responsible for travel, lodging, childcare, transportation, or other third-party costs.
4. Transfers and Resale
A ticket may be gifted or transferred unless the event or ticket type states otherwise. Unauthorized commercial resale, price gouging, duplication, counterfeiting, or resale through a method that creates confusion or fraud is prohibited. We may cancel tickets connected to prohibited resale or fraud.
5. Arrival, Admission, and Security
- Arrive during the date and entry window shown on the ticket. Late entry is not guaranteed.
- Have the ticket or QR code ready and provide reasonable order information or identification when needed to verify a purchase or age requirement.
- Follow staff instructions, posted signs, queue rules, emergency procedures, and event-specific requirements.
- Security screening, bag restrictions, and prohibited-item rules may be used. Refusing a reasonable safety screening may result in denied entry.
- Admission may be refused or revoked for unsafe, disruptive, threatening, abusive, intoxicated, fraudulent, or unlawful conduct, or for violating these Terms or venue rules.
- A removed guest is not entitled to a refund unless required by law.
6. Prohibited Conduct and Items
The following are prohibited unless Dark Hour gives specific written permission:
- Weapons, firearms, knives, explosives, fireworks, open flames, laser pointers, or other dangerous items.
- Illegal drugs, outside alcohol, or entering while impaired in a way that creates a safety concern.
- Touching performers, staff, props, sets, displays, barriers, equipment, or other guests without permission.
- Running, fighting, threatening behavior, harassment, hate speech, intentional damage, theft, or interference with operations.
- Masks, helmets, oversized costumes, inflatables, stilts, handheld props, or costume pieces that block vision or create a safety risk, unless an event specifically allows them.
- Photography, flash, video, live streaming, or phone use where prohibited. Recording rules vary by attraction and event; follow posted instructions.
- Commercial activity, solicitation, unauthorized vending, or distribution of promotional materials.
7. Haunted House Safety Warning
Dark Hour Haunted House is an intense entertainment experience. It may include darkness, strobe or flashing lights, fog or theatrical haze, loud sounds, sudden noises, confined or narrow spaces, uneven or changing surfaces, moving effects, frightening images, startle effects, close performer interaction, and incidental contact.
Do not enter if you believe the experience may be unsafe for you. Guests with heart, respiratory, seizure, balance, mobility, sensory, anxiety, pregnancy-related, or other medical concerns should consider the warnings carefully and consult a qualified medical professional when appropriate. This is general safety information, not medical advice.
Performers are instructed not to intentionally touch guests unless a particular experience clearly states otherwise. Because performers may come very close, incidental and unintentional contact can occur. Guests must not touch performers.
Closed-toe, secure footwear is strongly recommended. Walk carefully, do not run, and immediately follow staff directions if you need assistance or wish to exit.
Guests may not lift or carry children while walking through any Dark Hour attraction, including carrying a child in their arms, on their shoulders, or piggyback. Dim lighting and uneven or changing walking surfaces make carrying a child unsafe. Each child must be able to move safely through the attraction and remain under the direct supervision of a responsible adult.
8. Museum Experience and Parental Discretion
The North American Cryptid Museum is an immersive exhibition about folklore, reported encounters, regional legends, and zoological unknowns. It may include dim lighting, ambient sound, unsettling imagery, life-size creature displays, and spooky subject matter. It is generally designed without jump scares or live scare performers, but parents and guardians should use their own judgment for children or sensitive guests.
Museum descriptions present historical accounts, folklore, reported evidence, and differing theories. They are offered for education and entertainment and should not be understood as a guarantee that any reported creature, event, or claim is scientifically verified.
9. Accessibility and Accommodations
We aim to provide a welcoming experience and reasonable access. Attraction features and safety requirements may differ between the haunted house, museum, special events, and behind-the-scenes areas. Contact us before purchasing when you need information about mobility access, sensory conditions, service animals, or another accommodation. We will evaluate reasonable requests based on the attraction, safety requirements, staffing, and applicable law.
10. Changes, Closures, and Force Majeure
Attraction content, performers, exhibits, operating procedures, entry times, capacity, and event details may change without notice. We may delay, pause, close, relocate, reschedule, or modify an event because of weather, power or technology failure, staffing, safety, government action, emergency, maintenance, public health, or other circumstances outside our reasonable control. Any refund, credit, or rescheduling option will be limited to what we announce for the affected event and what the law requires.
11. Website Rules and Intellectual Property
The websites, logos, attraction names, artwork, photographs, videos, text, designs, graphics, ticket materials, and other content are owned by Dark Hour or used with permission. You may use the website for personal, noncommercial ticketing and information purposes. You may not copy, scrape, republish, sell, reverse engineer, interfere with, or misuse the website or content without permission.
Do not attempt to access another person’s order, bypass security, introduce malicious code, overload systems, automate purchases in a way that disrupts availability, or use the website for fraud or unlawful activity.
12. Third-Party Services and Links
Ticketing, payment, purchase protection, maps, social media, and other features may be provided by third parties. Their terms and privacy policies also apply to your use of their services. Dark Hour is not responsible for a third party’s website, system availability, claim decision, content, or independent conduct, except to the extent required by law.
13. Disclaimers and Limits of Liability
Attractions and websites are provided on an “as available” basis. To the fullest extent permitted by law, Dark Hour does not guarantee uninterrupted website access, exact wait times, a particular performer or scene, or that every description, image, schedule, or system will always be error-free or current.
To the fullest extent permitted by law, Dark Hour will not be liable for indirect, incidental, special, exemplary, or consequential damages, or for lost travel costs, lost profits, or lost opportunities arising from a website, ticket, or visit. For a claim involving a paid ticket, Dark Hour’s total liability will not exceed the amount paid to Dark Hour for the affected ticket, unless a greater remedy is required by law.
Nothing in these Terms excludes or limits responsibility that cannot legally be excluded or limited, including liability imposed by applicable law for gross negligence, willful misconduct, or other nonwaivable rights.
14. Governing Law and Disputes
Texas law governs these Terms, without regard to conflict-of-law rules. Before filing a lawsuit, you agree to contact us and give us a reasonable opportunity to resolve the issue informally. Unless applicable law requires another location, any court proceeding must be brought in a state or federal court with jurisdiction in Collin County, Texas.
15. General Terms
If one part of these Terms is found unenforceable, the remaining parts will continue in effect. A failure to enforce a term is not a waiver of that term. Event-specific rules, safety notices, ticket descriptions, and the Privacy Policy are incorporated into these Terms. If an event-specific rule conflicts with these general Terms, the more specific rule controls for that event, unless prohibited by law.
We may update these Terms by posting a revised version with a new effective date. The Terms in effect when you make a purchase generally apply to that purchase, except that current safety, security, and conduct rules apply during your visit.
